Date : 18 Feb, 2009 Question Dear Sir, I have got sanction of housing loan from IDBI for Rs 10 lac, but had only got Rs 8 lac disbusred. This happened in the year 2002. My EMI of about Rs9000/- pm started in the year 2002 and I paid till 2003 end. Thereafter I could not pay and again started paying Rs 10747/- pm as I was asked to pay by IDBI. Till last dec 08 I was paying the EMI, the latest being Rs 11,245/- pm. Now when my friend went to deposit the cheques, they have refused to take the same and said that I need to pay Rs 3 lac which I had not paid during the default period of 2003-2004, failing which the possesion of the house would be taken. Kindly advise as to what I need to do, otherthan pay Rs 3 lac, as I have been paying Rs 10747/- pm against a loan of Rs 8 lac. If I pay Rs 3 lac, will the bank return excess amount charged ( ie rs 10747- Rs 9000) over the last 5 years or will it get adjusted against the loan tenor. Kindly advise. Answer Since you have defaulted on the loan, the bank may charge extra interest and if the loan is not settled, the bank may also take possession of the property.
