The Consumer Court directed New India Assurance Company to pay Rs. 4.7 lakh to the vehicle owner. The forum said that the insurance company had rejected the claim on flimsy grounds. Thus,it was guilty of deficient service.
Consumer forum said that New India Assurance was liable to pay Rs 4.5 lakh for the for the vehicle which was insured and also pay Rs 20,000 as a compensation for causing harassment to Uday Singh, the vehicle owner.The decision came in the case where, Uday Singh whose dumper had been insured by New India Assurance for Rs. 4.75 lakh on March 31, 2005. The dumper was permitted to ply in Haryana and Delhi. The vehicle was stolen from his house. The company denied the claim filed saying that the insured had used the dumper in Delhi in violation of the terms and conditions of the insurance policy. The insurer maintained that the vehicle could be brought here for unloading goods.
